 REGISTRATION TERMS AND CONDITIONS FOR ONLINE AND IN-CLASS TRAINING

Welcome to Sculpted Studios Training Academy. At Sculpted Studios, we do things differently. We believe strongly that students should not only have a very firm understand of the fundamentals but comprehend the why and how behind every decision they will make as artist and that you leave with more than ability you leave class with all the components for success, making Sculpted Studios one of the most sought after trainings for permanent makeup. This agreement is effective after the 24 hour-registration grace period. After which time, all fees and deposits are deemed non-refundable and non-transferable. By proceeding forward with online registration and accessing the online portal, students acknowledge and agree to the following terms and conditions set forth by Sculpted Studios.

Students must be sure to read and comprehend this enrollment agreement thoroughly. This agreement outlines the conditions all students must abide by while enrolled in training with Sculpted Studios. It is a legal understanding stating that students have accepted and read the Sculpted Studios terms. The student understands that all students will receive a certificate of completion for the training however to be a recipient of certification in this course; they must meet the requirements necessary; this solely depends on the student’s willingness to apply methods learned in this training properly as outlined in our Sculptura Certification, details available on our website.

1. USER REGISTRATION AND ACCOUNT DETAILS

All registered students must be over the age of 18. Each student will be added into the platform using the email address provided upon registration and assigned a unique password to access their account. In the event students forget their password, it should be reset through the online portal. Please do not contact us to reset your password.

2. CLASS MATERIALS

PRE-TRAINING ONLINE: This is a MANDATORY 14 day online pre-training, all content provided by Sculpted Studios is digital content only. Starter kits are not needed for this portion of the training. Students will receive all starter kits and materials on the first day of their scheduled in-class training date. We will be monitoring your progress within the online precourse, if you are not progressing in a timely manner, we reserve the right to cancel your enrollment. Rescheduling of your course is subject to Sculpted Studio’s discretion. Failure to compete your mandatory pre course may result in the forfeiture of your payment and cancelation of your class.

INCLUDED MATERIALS: If for whatever reason we are out of stock in a certain “included item” we hold the right to substitute with something similar. If we do not have the SCULPTURA machine in stock we reserve the right to substitute with the Dragon Hawk Mast Tour and will give a student discount to be used for purchasing the SCULPTURA when it is back in stock.

3. TUITION

A non-refundable and non-transferable deposit of $1,000 is required, per course, to reserve your spot within any of Sculpted Studios training courses.

All balances are due in full the day before the start of the 14 Day Online Pre-Training-NO EXCEPTIONS. Failure to submit final payment will result in our inability to send you your mandatory pre training. With out completing your pre training you will be unable to participate in the in person portion of your training. A 2.9% merchant processing fee will be added onto the total balance due. WE DO NOT ACCEPT CHECKS OF ANY KIND- NO EXCEPTIONS.

4. NON-REFUNDABLE FEES

After 24 hours of registration, all fees paid toward the training date are non-transferable and non-refundable- NO EXCEPTIONS. As we also offer Payment Plans (APPLY HERE). Payments received in this form are non-refundable and non-transferable- NO EXCEPTIONS

5. CANCELLATION PERIOD & WITHDRAW POLICY.

24 hours after initial registration and 24 hours after receipt of final payment, any and all fees paid toward the training date are non-transferable and non-refundable-NO EXCEPTIONS. In the event a student wishes to withdraw from their registered class date, this will result in a forfeiting of their deposit and any additional fees paid toward the class.

6. NON-DISCRIMINATION

Sculpted Studios shall not discriminate based on race, religion, sex, sexual orientation, marital status, or age.

7. ATTENDANCE AND TARDINESS

To complete the course and obtain certification, students must respect daily class times which are the following: 10:00 a.m. arrival time and ~6:00 p.m. concluding time every day. There will be instances where the class will start earlier or run beyond the concluding time and students will be required to attend or stay on until the instructor feels that all students have reached the level needed for that day.

Students who are absent during any of these hours must consult the Enrollment Agreement terms and assume liability for any further charges. Other conditions for obtaining certification include performing on live models and attending all prescribed hours. Preparedness to perform on a live model is dependent entirely on the instructor’s judgment. If the requirements cannot be sustained by the student, tuition will not be reimbursed.

8. ADVANCED STANDING

Past education or training cannot grant students advanced standing in this course.

9. SATISFACTORY PROGRESS POLICY & EVALUATION

Adequate progress by students must be sustained during the course instruction. Evaluation at each stage of the class will take place to monitor student progress. In the event a student is unable to perform at a level that ensures the implementation of safe practice, a certificate of completion shall not be given regardless of completion of other stated requirements.

11. STUDENT CONDUCT

Inappropriate student conduct will not be tolerated. Expected student conduct is summarized in the Ethics Statement. If a student behaves in a disorderly manner, they will be dismissed from this course. Disorderly student conduct includes but not limited to disturbance or persecution towards the instructor or other students, inappropriate speech, or the use/possession of drugs or alcohol. Instructors shall be knowledgeable on these points and ensure that they are maintained.

12. STUDENT HYGIENE

All students are expected to adhere to hygiene requirements which ensure that students are presenting themselves appropriately as well as adhering to OSHA requirement for Tattoo Artists. The following hygiene requirements are applicable to all students-NO EXCEPTIONS:

• Maintain personal cleanliness.

• Oral hygiene (brushing of teeth) required.

• Use of deodorant/antiperspirant to minimize body odors.

• No heavily scented perfumes, colognes and/or lotions. These can cause allergic reactions, migraines and respiratory difficulty for others.

• Clean and trimmed fingernails (¼ inch long or less)

• Extreme false eyelashes are not permitted.

• Clothing must be clean, in good condition and fit appropriately

• Open toe shoes are not permitted. Wearing high-heeled shoes is not recommended.

• Long hair must be tied back and away from the face if operating equipment.

• Clothing must not interfere with the operation of equipment.

• Limited jewelry and no dangling or large hoop jewelry that may create a safety hazard. A general rule of thumb is that if a pencil can be passed through a hoop earring it is not safe to wear near operating equipment.

• Tattoos that are perceived as offensive, hostile or that diminish the effectiveness of professionalism must be covered and not visible.

• Aprons will be supplied to students and you will be required to wear them.

The following items are not permitted to be worn during training:

• Sweat or jogging pants

• Pants that expose the midriff or underwear

• Short shorts

• Low-cut tops

• Halter tops

• Tops that expose the midriff or underwear

• Any form of clothing that is mesh, sheer, see-through, torn or otherwise revealing

• Any form of clothing that is generally offensive, controversial, disruptive or otherwise distracting

• Flip-flops or sandals

It is within our discretion to send a student home to change if they arrive to training in what is deemed to be inappropriate attire/ hygiene.

12. TERMINATION POLICIES

A first offense of disruptive behavior will result in a written warning. If a second offense takes place, the dismissal of the student from the course will occur. One year following student dismissal, reapplication will be available, however, this does not secure admission.

13. CANCELLATION POLICY

A spot in the course can be reserved paying a $1000 deposit or full tuition. Students have 24 hours after the first installment to file a notice of intent to obtain a full refund of tuition or deposit fees.

There is no refund of the initial payment for students attempting to cancel later than 24 hours. At the time of deposit payment, the amount paid will be removed from the tuition, and the outstanding balance of the tuition is due on or before delivery of the Online Pre Course or the first day of the in person course. There will be no refund if a student cancels after 24 hours of the initial payment or if the student is not present during class time. Also, there will be no refunds if the student decides not to attend all the class days or feels that they did not like/benefit from the class. Under emergency circumstances with evidence, students may enroll in the next available course time without any additional charges.

Acknowledgment and understanding of refund and cancellation terms are required of students. Students must accept and agree to the rights and responsibilities listed above.

14. PRIVACY POLICY

By registering for any of Sculpted Studios courses, all students consent to receiving correspondence regarding class updates and information, as well as promotional marketing through all forms of digital/electronic correspondence including but not limited to U.S. mail, e-mail, text messages, phone calls, and social media. Every student has the right to opt out and unsubscribe at any time.

15. SCULPTED STUDIOS AFFILIATES

Each student acknowledges that by registering and training with the Sculpted studios, it in no way constitutes the authority to act on behalf of, or market oneself as a representative, employee, contractor, or trainer with Sculpted Studios or Academy.

16. DISCLAIMER

The materials included in the 10 day online pre-training and student manual are for informational/educational purposes only. It is not intended to provide legal or medical advice, or to address all circumstances that might arise. Students using this document are encouraged to use their own judgement and to consult their own legal/medical counsel. By applying the business practices and methods discussed in the curriculum we do not promise or guarantee employment, profit, or marketing know-how.

Sculpted Studios is not responsible for any events outside of our control that may result in a delay of training both online and in-class. This includes, but is not limited to natural disasters, pandemics, government regulations, electrical power outages, interruptions in telecommunications, or the loss of personal electronic devices.

17. INTELLECTUAL PROPERTY

Any infringement of your online student account or student training manual (including but not limited to sharing account information with another individual, or reproducing, distributing, or transmitting content or design of the course, in any form or by any means, including photocopying, recording, or other electronic or mechanical methods) shall be cause for immediate dismissal from the course and will result in legal action against the registered individual.

18. LIMITED LICENSE

Under copyright law, a limited license restricts students from sharing any of the information within this course both digital and printed. Only the registered student may download, print, save, and use any materials provided within the course.

19. LIABILITY AND HOLD HARMLESS

Sculpted Studios denies any liability from any and all claims, demands, damages, actions, causes of action or suits of any kind or of any nature whatsoever that may arise hereafter out of or in any way relating to any and all injuries, damages, losses of any and every kind, pertaining, but not limited to both personal property, personal injuries, losses, or damages that may develop in the present or future as a result of or in any way relating to our training program(s).

20. FORCE MAJEURE

In case of a Force Majeure (FM) which includes natural disasters, accidents or interruptions to transportation, strikes or health
issues which might prevent Sculpted Studios MASTER TRAINER from performing his/her obligations under this agreement, he/
she will be excused.
a. Upon occurrence of a Force Majeure event, the student will be notified of the occurrence of that Force
Majeure event, its effect on the performance of duties, and how long it is expected to last. Both parties shall use reasonable efforts to limit damages and to resume the performance as agreed. Sculpted Studios will not be responsible for any costs, including participants travel expenses in case of the FM event. In the event of a FM, students will have to option to choose the same course type on a future date within 6 calendar months of their initial scheduled course.
